Known as a "brilliant" legal mind, Mwenda was highly competent, winning 26 straight cases and garnering admiration for his skillful courtroom arguments. His story captured public attention not only because of his impressive win streak, but also due to his audacity in presenting himself as a legitimate advocate. How Mwenda Fooled Everyone, and How He Got Caught
The Law Society of Kenya reported that Mwenda illicitly accessed their system, found an account with a similar name, and altered the information by replacing the original photo with his own to pose as a legitimate lawyer, according to a Ghana Web article. Following an emergency meeting, they concluded that Mwenda had stolen the identity of a real attorney named Brian Mwenda Ntwiga.
The real Brian Mwenda Ntwiga was admitted to the Bar on Aug. 5, 2022, with an account set up for him in the Advocates portal using his correct email. According to the Law Society of Kenya, Ntwiga had not applied for a practicing certificate, as he worked for the Attorney General's office, where it was unnecessary. However, in September 2023, when he tried to access his portal to apply for the certificate, he discovered he was locked out of his account. He alerted the IT department, who quickly determined that the contact details on his profile had been changed to those that did not belong to him.
Public Reaction and Mwenda's Unusual Defense
Following his arrest, Mwenda managed to maintain a substantial base of supporters, with some viewing him as a folk hero. According to reports, Mwenda addressed his supporters on social media, expressing gratitude for their continued loyalty. For many, Mwenda's success exposed how a talented yet unqualified individual could potentially outperform licensed attorneys, prompting mixed reactions from the public. While some believe his actions were criminal, others argue that his success points to systemic flaws rather than personal failings. Kenya's Central Organisation of Trade Unions (COTU) even commended him as a "brilliant young mind" who achieved success "without conventional qualifications."
Brian Mwenda's Trial
On Aug. 8, 2024, Brian Mwenda stood trial for impersonating a High Court advocate, facing multiple charges including forgery, identity theft, and fraud. He is accused of creating a fake certificate of admission to practice law, intending to deceive by presenting it as an official document issued by the High Court's deputy registrar. Additionally, Mwenda allegedly used a forged admission certificate at a Nairobi law firm in March 2023 and produced a fake 2023 practicing certificate, claiming it was issued by the judiciary’s chief registrar.
